I was in an accident in Alabama and spent 15 days in the hospital. The other person was found at fault. My insurance company told me I need to file a claim on my health insurance. I have $25,000 of personal injury protection (PIP). However, the hospital bill is $50,000. How can I recoup lost wages and pain and suffering damages?

Dear Russell,
I posed your question to Steve Stewman, senior investigator with the Consumer Services Division of the Georgia Department of Insurance. He says that you should file a claim for your hospital bills under your health insurance. Your health insurance company would then seek reimbursement from your auto insurance company for the amount that your PIP covers.
The other driver's liability insurance should pay for your lost wages and pain and suffering. If the other driver does not have enough liability insurance to cover this, you have the right to sue the other driver for damages. For more on this, read When to hire a personal injury lawyer.
