What happens if I'm hit by a person who has no insurance and the vehicle that hit me is still being paid for?

When you are hit by an uninsured motorist, you can file a claim on your collision insurance. You can then ask the other driver to reimburse you for your deductible. If he or she refuses, you have the right to sue.

If you do not have collision insurance, you can ask the other driver to pay for damages. Again, if he or she refuses, you have the right to sue. Also, Kansas law says that if you are injured and your medical costs exceed $2,000, you have the right to sue for pain and suffering.

Whether or not the other driver's car is paid for has no impact on your rights to have your car restored to pre-accident condition.
