Can a person change the beneficiary of a life insurance policy from his legally married spouse to another family member — an adult child, for example — without the knowledge and/or written consent of his spouse, the original beneficiary?

Dear Martha,
In general, a person is free to change the beneficiary of his or her life insurance policy to whomever he or she wishes, except when that right is restricted either by law or the life insurance contract.
According to Bobby Ann Clark, a spokesperson for the Louisiana Department of Insurance, there is nothing in Louisiana law that would prevent the owner of the life insurance policy from changing the beneficiary from his legal spouse to another person without her consent.
