Question:

I didn't tell my car insurance company about a claim because I believed that a previous outstanding claim (still in the processing stage) could be affected. After filing the first claim, I received a notice of cancellation for nonpayment of premium. Two weeks after the effective date of the cancellation, I filed my second claim. Will my second claim still be covered under that car insurance policy?

Question:

It depends on when the second accident occurred. Your personal auto policy applies to accidents that occur during the policy period as shown in your declarations. There is no required "reporting period," so if your second loss occurred during your policy period, even if the policy was in the process of being cancelled, the policy should pay out.

If there's a question of whether your policy was in force, that depends on the circumstances of the case. If your policy was cancelled in accordance with state law, and the loss occurred after the effective cancellation date, then your policy was not in force and the policy does not cover the loss. If the cancellation was not effective at the time of the loss, the policy should pay (unless there is some exclusion that applies to the claim).
