If I am rear ended, whose insurance pays and how much?
You would make a claim against the policy of the person who rear-ended you. Their insurance company should pay you for your repairs and a rental car for the time your car is in the shop. I assume there were no injuries?
Alternately, if you have collision insurance you could use that for your repairs, but you’ll have to pay your collision deductible.
I’d do the claim against the at-fault driver.
