Florida class action suit clears way for others
A class action lawsuit approved by the Florida Appeals Court may open the path for additional lawsuits across the country, according to one of the lawyers in the suit. The suit filed against Integon General Insurance Corporation, a division of GMAC Insurance Company, seeks damages due to the use of inferior replacement parts in the repair of automobiles. The lawsuit was filed on behalf of Roy Sweeney of Broward County, Fla. Involved in an accident, Sweeney's car was repaired under the other driver's insurance, Integon, using after-market parts. According to the complaint, use of non-original equipment manufacturer (OEM) parts "violates the obligations Integon owes to its policyholders and other whose cars are damaged by Integon policyholders." The suit further alleges that the parts may reduce the safety of the vehicle and may also in some cases void the auto manufacturer's warranty.
